{"id":2,"date":"2021-03-29T12:03:08","date_gmt":"2021-03-29T12:03:08","guid":{"rendered":"https:\/\/patentecomunitaria.com\/?page_id=2"},"modified":"2025-12-09T13:24:16","modified_gmt":"2025-12-09T13:24:16","slug":"pagina-ejemplo","status":"publish","type":"page","link":"https:\/\/patentecomunitaria.com\/","title":{"rendered":"PATENTE COMUNITARIA"},"content":{"rendered":"\r\n<p class=\"wp-block-paragraph\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone\" src=\"https:\/\/www.ull.es\/portal\/noticias\/wp-content\/uploads\/sites\/13\/2018\/02\/euroflag.jpg\" alt=\"Una Europa que cumple: la Comisi\u00f3n presenta ideas para una Uni\u00f3n Europea  m\u00e1s eficiente - ULL - Noticias\" width=\"428\" height=\"107\" \/><\/p>\r\n<p><strong>De momento\u00a0NO EXISTE UNA la figura legal de PATENTE COMUNITARIA<\/strong>, \u00a0cosa que si ocurre con la MARCA COMUNITARIA, lo que existe son una serie de figuras que a trav\u00e9s de ellas puedes tener una protecci\u00f3n efectiva en los pa\u00edses Miembros de UNION EUROPEA.<\/p>\r\n<h6>As\u00ed pues, las principales v\u00edas de protecci\u00f3n en los 27 pa\u00edses de la UNION EUROPEA son:<\/h6>\r\n<h5 style=\"text-align: center;\"><span style=\"color: #0000ff;\">SOLICITUD DE\u00a0<strong>PATENTE EUROPEA<\/strong><\/span><\/h5>\r\n<p>Es un tr\u00e1mite unificado de <strong>solicitud y concesi\u00f3n<\/strong> en los Pa\u00edses adheridos al Convenio de la Patente Europea (hasta 44 pa\u00edses mazo 2021), que luego hay que validar en cada pa\u00eds miembro dando lugar patentes nacionales con vida propia.<\/p>\r\n<p>Los 27 pa\u00edses que forman actualmente la UNI\u00d3N EUROPEA esta incluidos en este convenio de la PATENTE EUROPEA.<\/p>\r\n<p>Lo que se ha de tener claro es que una vez la Oficina Europea concede una patente esta pasar a ser gestionada por las oficinas de los estados miembros, teniendo que pagar las tasas de mantenimiento a cada una de ellas por separado, es decir si queremos la protecci\u00f3n para los 27 pa\u00edses pasar\u00edamos a mantener 27 patentes<\/p>\r\n<p align=\"justify\">El organismo encargado de su tamitaci\u00f3n y concesi\u00f3n es la <a href=\"https:\/\/www.epo.org\/\">Oficina\u00a0 Europea de Patentes (EPO)<\/a><\/p>\r\n<p style=\"text-align: center;\">Mas informacion sobre patente europea: <a href=\"http:\/\/www.patenteeuropea.info\/\">www.PatenteEuropea.info<\/a><\/p>\r\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-37 \" src=\"https:\/\/patentecomunitaria.com\/wp-content\/uploads\/2025\/12\/logo-epo.png\" alt=\"\" width=\"145\" height=\"75\" \/><\/p>\r\n<figure aria-describedby=\"caption-attachment-36\"><\/figure>\r\n<figure class=\"wp-caption alignnone\" aria-describedby=\"caption-attachment-36\"><hr \/>\r\n<h5><span style=\"color: #0000ff;\">SOLICITUD DE\u00a0<strong>PATENTE NACIONAL<\/strong><\/span><\/h5>\r\n<p>Se trata de un tr\u00e1mite de solicitud y concesi\u00f3n en \u00a0cada uno de los 27 pa\u00edses de forma individual \u00a0o separada<\/p>\r\n<p>Esta opci\u00f3n es muy costosa, ya que se van a tener que pagar 27 tr\u00e1mites y 27 concesiones, solo vale la pena cuando se quiere proteger la invenci\u00f3n en un n\u00famero limitado de pa\u00edses.<\/p>\r\n<p>Mas informacion sobre solicitudes nacionales: <a href=\"http:\/\/www.registrarpatente.com\/\">www.RegistrarPatente.com<\/a><\/p>\r\n<\/figure>\r\n<hr \/>\r\n<h5 style=\"text-align: center;\" align=\"justify\"><span style=\"color: #0000ff;\">SOLICITUD DE UNA\u00a0<strong>PATENTE INTERNACIONAL\u00a0 &#8211;
